Assault and Battery
Virginia Code §18.2-57 distinguishes assault and battery as two separate
crimes. These two offenses are sometimes charged together and the leading
consequences can result in jail or prison time, fines and restitution.
Assault is the crime of knowingly and willingly threatening a person with
imminent bodily harm. Battery is the actual physical assault on the victim.
Murder is the most aggressively prosecuted offense in the state of Virginia
and any state in the U.S. In order to be convicted of a murder, prosecutors
must prove that you had malice aforethought and that the crime was pre-meditated.
Murder, also referred to as homicide, can carry penalties including life
in prison without parole and the death penalty.
Manslaughter is a separate charge from murder. The main difference in
manslaughter cases are that the vast majority of them occur without malice
aforethought. Many of these incidents stem from negligence or the "heat
of the moment." While these are technically "lesser" crimes
than murder, they still hold immense penalties and steep consequences.
