What Wrongful Death Means Under Virginia Law
Under Va. Code § 8.01-50, wrongful death is defined as a death caused by the wrongful act, neglect, or default of another person or entity. A claim can be pursued when the circumstances would have allowed the deceased to bring a personal injury lawsuit had they survived. The negligent party doesn’t need to have intended to cause the death. Carelessness and recklessness are enough.
Wrongful death is a civil matter, separate from any criminal case, and its purpose is financial recovery for the surviving family. Common causes in the Newport News area include:

Who Can File a Wrongful Death Claim in Virginia
Virginia law requires that a wrongful death claim be filed in the name of the personal representative of the deceased’s estate. Individual family members can’t file directly. Under Va. Code § 64.2-454, when no executor or administrator has already been appointed, a personal representative can be appointed by the clerk of a Virginia circuit court solely for the purpose of bringing the lawsuit, without requiring full estate administration, provided at least 60 days have elapsed since the date of death. For Newport News decedents, that appointment runs through Newport News Circuit Court.
The statutory beneficiaries who may receive recovered compensation are set out in Va. Code § 8.01-53. The first class consists of the surviving spouse, children of the deceased, and children of any deceased child of the deceased. Qualifying parents may also share in this first class if they regularly received support or services from the decedent in the 12 months before death. When no first-class beneficiaries exist, parents, brothers, and sisters of the deceased, and certain dependent relatives may recover. Under Va. Code § 8.01-52, surviving family members may recover both economic and non-economic damages. The amount varies based on the facts of the case and the identity of the surviving beneficiaries. We pursue the full range of compensation available to our clients.

Under Va. Code § 8.01-244, a wrongful death action must be filed by the personal representative within two years of the date of death. Missing that deadline generally forecloses the ability to pursue compensation through a wrongful death claim.
