How Intent to Distribute Differs from Simple Possession
Virginia law treats simple possession separately from possession with intent to distribute. Virginia Code § 18.2-250 addresses simple possession, while § 18.2-248 prohibits manufacturing, selling, giving, or distributing controlled and imitation controlled substances. It also prohibits possessing those substances with the intent to manufacture, sell, give, or distribute them.
An intent-to-distribute allegation doesn’t require proof of a completed sale. Instead, the Commonwealth alleges that the accused possessed or controlled a substance and intended to transfer it to someone else. That allegation can significantly change the classification and potential consequences of the charge.
Prosecutors may rely on circumstantial evidence: facts used to support an inference rather than direct proof of a transaction. Their theory may draw on the amount of the substance, its packaging, cash, communications, and statements. Each item must be examined in context rather than treated as automatic proof of distribution.
Potential Penalties for Drug Distribution in Virginia
Potential penalties depend on the substance, its controlled-substance schedule, the amount involved, prior convictions, and other statutory factors. These schedules are legal classifications for substances. The specific offense charged matters because the possible consequences vary sharply among categories.
Virginia law includes the following penalty classifications:
- Schedule I or II substances: Under Virginia Code § 18.2-248(C), a first conviction for distributing or possessing with intent to distribute carries five to 40 years of imprisonment and a fine of up to $500,000.
- Schedule IV substances: Distributing or possessing with intent to distribute is a Class 6 felony under subsection E2.
- Schedule V or VI substances: Distributing or possessing with intent to distribute, including an imitation of either, is a Class 1 misdemeanor under subsection F.
- Marijuana: Virginia Code § 18.2-248.1 classifies an allegation involving no more than one ounce as a Class 1 misdemeanor. An amount of more than one ounce but no more than five pounds is a Class 5 felony.
Subsection D also contains an accommodation provision for certain Schedule I or II allegations. Accommodation distribution generally involves transferring a substance without intending to profit or induce addiction. When the statutory conditions are established, the conduct is subject to a reduced offense. Whether the provision applies depends on the evidence.
Evidence & Defenses in Intent-to-Distribute Cases
The Commonwealth must prove every required element beyond a reasonable doubt. Generally, those elements include possession or control of the substance, knowledge of its presence and character, and intent to distribute it. Our preparation focuses on whether admissible evidence establishes each element.
Issues that may affect the defense include:
- Illegal search and seizure: A defense may challenge how officers stopped a person, entered property, conducted a search, or seized alleged evidence.
- Lack of knowledge: The facts may not establish that the accused knew the substance was present or understood its character.
- Constructive possession: Prosecutors may claim that a person knew about and controlled a substance even though it wasn’t found in the person’s physical possession.
- Weak evidence of intent: The quantity or surrounding circumstances may support an explanation other than distribution.
- Entrapment: Government inducement may be relevant when the facts support this defense, particularly if the accused wasn’t otherwise predisposed to commit the alleged offense.
No single defense applies to every arrest. We investigate the claimed connection between the accused and the substance, review the circumstances of police conduct, and consider alternative explanations for the possession and other evidence.
How a Newport News Felony Case Moves Through Court
A felony possession-with-intent charge generally begins with a preliminary hearing in Newport News General District Court. At that hearing, a judge determines whether probable cause exists to send the charge forward. Probable cause is a lower standard than the proof beyond a reasonable doubt required for a conviction.
The case may reach Newport News Circuit Court through certification after a preliminary hearing or through a grand jury indictment. Newport News Circuit Court is part of Virginia’s 7th Judicial Circuit and has jurisdiction over felony criminal cases and trials. The path and timing depend on how prosecutors proceed and what occurs during the earlier stages.
We investigate each case and work directly with clients to understand their priorities. Our familiarity with the local courts informs our preparation, and access to relevant evidence and witnesses allows us to examine the prosecution’s account. We pursue an acceptable pretrial resolution when possible and prepare to go to court when one isn’t secured.
