Hotels and motels face an even stricter standard. The Virginia Supreme Court’s decision in Taboada v. Daly Seven, Inc. established that hotel operators owe guests a duty of utmost care and can be held liable for even slight negligence that was foreseeable.

The Civil Claim vs. the Criminal Act

A negligent security claim is a civil action against the property owner, not the attacker. A case can proceed even if the person responsible for the crime is never identified or convicted.
