Workers’ Compensation & Third-Party Liability

Virginia workers’ compensation may provide benefits to an employee injured while performing job duties. However, a personal injury lawsuit against an employer isn’t automatically available simply because an accident occurred at work. The responsible parties and employment relationships must be reviewed before the available claims can be identified.

Third-party liability refers to the legal responsibility of someone other than the injured worker’s employer or a protected co-worker. Depending on the facts, a third party could be a subcontractor, staffing company, property owner, equipment manufacturer, maintenance provider, or another business operating at the site.

These claim paths can involve different procedures, deadlines, and forms of recovery. The analysis may depend on who controlled the work, who owned or maintained the forklift, whether an equipment defect contributed to the incident, and which employment-injury laws apply. Receiving workers’ compensation benefits doesn’t resolve every question about possible third-party responsibility.

Documenting Serious Injuries & Financial Losses

Forklift incidents can cause traumatic brain injuries, spinal cord damage, fractures, amputations, crush injuries, internal injuries, burns, chronic pain, and permanent disability. After a fatal incident, surviving family members may also have questions about death benefits or civil claims.

Depending on the type of claim, relevant losses may include medical expenses, rehabilitation, medication, lost wages, reduced earning capacity, disability, disfigurement, pain, emotional harm, and diminished quality of life.

  • Don’t assume that an insurer’s request, statement, or payment addresses every potential claim.
  • Seek a legal review before evidence disappears or a filing period expires.

Virginia personal injury actions generally have a two-year limitation period, although exceptions and different rules may apply. The deadline must be evaluated based on the accident date, responsible parties, and type of action. Filing for one form of benefits may not protect every other potential claim.
